- 우리나라 항만 지역 대기오염물질 배출규제 및 관리의 문제점과 개선방안에 관한 연구 -
경제가 발전함에 따라 세계 교역량은 지속적으로 증가하고 있으며, 물동량 대부분은 선박에 의해 운송된다. 이에 따라 선박으로부터 배출되 는 대기오염물질은 매우 심각한 수준이며, 국제해사기구를 중심으로 국제 해운의 대기오염물질을 규제하고 있다. 한편, 세계 컨테이너 물동량 7위인 부산항이 세계 10대 초미세먼지 오염항만의 불명예를 안으면서 한국의 항만 지역 대기오염은 선진국의 주요 항만에 비해 심각한 수준임 이 드러났다. 하지만 기존 한국의 대기오염에 대한 규제는 육상 기인 대기오염물질 관리에 주로 집중되어 있다. 국제 해운 역사상 가장 강력한 환경규제인 국제해사기구의 IMO 2020 시행을 앞둔 시점에 이르러서야 「항만지역등 대기질 개선에 관한 특별법」, 「환경친화적 선박의 개발 및 보급 촉진에 관한 법률」 등 항만 지역 대기오염물질 관리의 근거가 되는 법을 시행하였다. 이에 본 연구는 미국, 유럽연합(EU), 중국 등 주요국의 항만 지역 대기오염물질 규제와 관련된 법제도 및 정책을 분석하여 한국의 제도와 비 교함으로써 한국의 정책 및 운영체계의 문제점을 도출하고자 한다. 주요국의 관련 법제도 및 정책과 비교 분석한 결과, 대기오염물질 중 황산 화물 배출규제에 집중되어 있으며, 질소산화물 규제가 제대로 이루어지지 않고 있다는 문제점이 드러났다. 또한, 육상전원공급장치 설치 의무 화에 대한 법적 근거는 마련되었으나, 이러한 장치의 이용 의무화를 하고 있지 않아 이용률 제고에 어려움이 있다. 이에 대한 개선방안으로 질 소산화물 배출 규제를 위한 연구 및 법제도 개선, 선박의 수전 장치 설치에 대한 재정적 지원, 육상전원공급장치 이용에 대한 인센티브 도입 등 육상전원공급장치 이용률 제고 방안을 제시하였다.
A Study on the Problems and Improvement Measures of Air Pollutant Emission Regulation and Management in Korean Port Areas
As the economy develops, the volume of global trade is constantly increasing, and most of the cargo is transported by ships. As a result, air pollutants emitted from ships are at a very serious level, with the International Maritime Organization playing a central role in regulating air pollutants in international shipping. Meanwhile, Busan Port, which ranks seventh in the world in container volume, was ranked as one of the world's 10 most polluted ports for ultrafine particulate matter, indicating that air pollution in Korea's port areas is at a serious level compared to major ports in developed countries. However, existing regulations on air pollution in South Korea have focused on controlling land-based air pollutants. It was not until the implementation of the International Maritime Organization's IMO 2020, the strongest environmental regulation in the history of international shipping, that the country enacted laws to manage air pollutants in port areas, such as the “Special Act on the Improvement of Air Quality in Port Areas” and the “Act on Promotion of Development and Distribution of Environment-Friendly Ships”. This study analyzes the legal systems and policies related to air pollutant regulation in port areas in major countries such as the United States, the European Union (EU), and China and compares them with the Korean system to identify problems in the Korean policy and operation system. The results of the comparative analysis with the relevant laws and policies of major countries reveal that air pollutants are focus primarily on the regulation of sulfur oxide emissions and that nitrogen oxide regulation is not properly carried out. In addition, although the legal basis for the mandatory installation of onshore power supply devices has been established, the use of these devices is not mandatory, which makes it difficult to improve the utilization rate. As a solution to this problem, this study suggests ways to improve the utilization rate of shore power supplies, such as improving research and legislation to regulate nitrogen oxide emissions, providing financial support for the installation of shore power connections on ships, and introducing incentives for the use of shore power supplies.
